- Description
Discusses the Waitangi Tribunal's recent Tamaki Makaurau Settlement Process Report (14 June 2007, WAI 1362) ('Settlement Process Report'). Reports the Crown's settlement practices are also the subject of a recent Court of Appeal decision; see New Zealand Maori Council v Attorney-General [2007] NZAR 569. Focuses on the effect of a proposed Treaty settlement in Te Arawa, and the case is discussed against the background of the constitutional status of the Treaty of Waitangi. This review also discusses the Court of Appeal's decision in R v Iti (CA 267-06, 4 April 2007, Hammond, O'Regan, and Wilson JJ), in which the concept of private and public places on marae is considered. The review ends with an update on the Draft United Nations Declaration on the Rights of Indigenous Peoples.
